These Terms of Service (“Terms”) govern access to and use of afterhoursvendingusa.com (the “Website”), operated by After Hours Vending LLC (“After Hours Vending,” “we,” “our,” or “us”).

By accessing or using the Website, you agree to these Terms. If you do not agree, do not use the Website.

1. Informational Website

The Website provides general information about:

  • After Hours Vending

  • Our vending-machine services

  • Potential product categories

  • Existing machine locations

  • Opportunities for venues to request additional information

The Website is not an online store. Products cannot be purchased, ordered, or reserved through the Website.

Information displayed on the Website does not constitute a binding offer, quote, guarantee, or contract.

2. Venue Inquiries

Venue representatives may use the contact form to express interest in hosting a machine.

Submitting an inquiry:

  • Does not guarantee approval or placement

  • Does not reserve a machine

  • Does not establish a partnership, agency, or contractual relationship

  • Does not require After Hours Vending to provide an estimate or service

  • Does not require a venue to accept a placement

We may evaluate a venue based on location, operating hours, customer demand, accessibility, security, licensing, legal requirements, machine availability, and other business considerations.

3. Separate Venue Agreements

Any vending-machine placement must be governed by a separate agreement accepted by After Hours Vending and the venue.

The separate venue agreement will control matters such as:

  • Machine placement

  • Installation

  • Product selection

  • Profit sharing

  • Venue responsibilities

  • Machine access

  • Maintenance

  • Damage or loss

  • Cancellation

  • Written notice

  • Machine removal

  • Other financial or operational terms

Unless expressly stated in a separate agreement, nothing on the Website creates a promise of free installation, a particular profit share, a specific product selection, or a particular removal schedule.

If these Terms conflict with a signed venue agreement, the signed venue agreement controls the venue relationship.

4. Customized Products and Machines

Product selections may be customized based on a venue’s customers, preferences, policies, eligibility, and legal requirements.

Products, brands, flavors, machine models, machine appearance, pricing, and availability may change at any time. Images are illustrative and may not represent the exact inventory available at every location.

After Hours Vending does not guarantee that a particular product will remain available.

5. Response and Service Expectations

We generally aim to respond to new venue inquiries within 24 to 48 hours.

For reported machine problems, we generally aim to respond within 24 hours.

These are service goals and not guaranteed response or repair times. Actual timing may depend on:

  • Venue access

  • Staff availability

  • Travel conditions

  • Parts and inventory

  • Safety concerns

  • Holidays

  • Emergencies

  • Circumstances outside our reasonable control

6. Existing Locations

The Website may identify venues where machines are currently installed, including The Funhouse and The Wooden Match.

After Hours Vending does not own or operate these venues. Operating hours, admission requirements, age restrictions, product access, events, and venue policies are determined by each venue and may change without notice.

Contact the venue directly before visiting if you need current information.

7. Tobacco and Nicotine Categories

The Website may display images or general descriptions of tobacco and nicotine categories for informational purposes.

These products:

  • Cannot be purchased, ordered, or reserved through the Website

  • Are not offered at every vending location

  • Are considered only for eligible, venue-approved 21+ locations

  • Remain subject to licensing, venue policies, age-verification requirements, product availability, and applicable law

Displaying an age-restricted product on the Website does not guarantee that it is available at any location.

Individuals under 21 must not attempt to obtain age-restricted products. Nothing on the Website is intended to encourage tobacco or nicotine use.

8. Product Information

We make reasonable efforts to present accurate product information, but product images, packaging, descriptions, and availability may change.

Third-party product names, logos, trademarks, and packaging belong to their respective owners. Their appearance on the Website identifies potential product categories and does not imply sponsorship, endorsement, partnership, or affiliation unless expressly stated.

Always review the manufacturer’s packaging, instructions, warnings, ingredients, and safety information before using a product.

AFTER HOURS VENDING DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF ACCURACY, AVAILABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

Some jurisdictions do not permit certain warranty exclusions, so portions of this section may not apply to you.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AFTER HOURS VENDING LLC AND ITS OWNERS, MEMBERS, EMPLOYEES, CONTRACTORS, AND REPRESENTATIVES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO:

  • Third-party websites or venues

  • Product availability

  • Unauthorized access to information

  • Website interruptions or errors

Nothing in these Terms excludes liability that cannot legally be excluded or limited.

14. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless After Hours Vending LLC and its owners, members, employees, contractors, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful misuse of the Website, violation of these Terms, or infringement of another party’s rights.

Your use of the Website is also governed by our Privacy Policy.

16. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law principles.

To the extent legally permitted, disputes concerning the Website or these Terms will be brought in the state courts located in Northampton County, Pennsylvania, or the federal courts having jurisdiction over Northampton County.

These Terms do not impose mandatory arbitration. Any arbitration requirement applicable to a venue relationship must be separately reviewed, negotiated, and stated in the applicable venue agreement.

17. Changes to the Website or Terms

We may modify, suspend, or discontinue any portion of the Website at any time.

We may update these Terms by posting a revised version with a new effective date. Continued use of the Website after updated Terms are posted constitutes acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. The unenforceable provision will be modified only to the extent necessary to make it enforceable where permitted by law.

19. No Waiver

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
